NEC Group – Free Wi-Fi Terms and Conditions of Use
PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THE NEC WI-FI SERVICE. BY CLICKING THE “CONNECT” BUTTON BELOW, YOU AGREE THAT YOU HAVE READ THESE TERMS AND CONDITIONS, AND THAT YOU WILL ABIDE BY THEM.
Interpretation
Capitalised terms shall have the meanings given to them in the list below:
“Additional Terms” Any additional terms which may apply to your use of the Wi-Fi Service at a particular NEC Venue, as indicated on the relevant log-in page.
“Agreement” These terms and conditions, together with any Additional Terms.
“NEC Group” The National Exhibition Centre Limited (Company Number 00979395) whose registered office is at The National Exhibition Centre, Birmingham, West Midlands, B40 1NT, and the terms “We”, “Our” and “us” shall be construed accordingly.
“NEC Venue” Any venue owned or operated by the NEC Group from time to time.
“Wi-Fi Service” The provision by us to you of wireless access to the internet during your visit to an NEC Venue (where available), in accordance with the terms of this Agreement.
“You” The person using the Wi-Fi Service, and “your” shall be construed accordingly.
Unless the context otherwise requires, words in the singular shall include the plural and vice versa.
A reference to a statute or statutory provision is a reference to it as amended, extended or re-enacted from time to time and shall include all subordinate legislation made from time to time under it.
Any obligation on a party not to do something includes an obligation not to allow that thing to be done.
Any words following the terms including, include, in particular or any similar expression shall be construed as illustrative and shall not limit the sense of the words, description, definition, phrase or term preceding those terms.
The Wi-Fi Service
We agree to provide the Wi-Fi Service to you, in accordance with and subject to your compliance with the terms of this Agreement. The Wi-Fi Service is intended for your personal use only. You must not re-sell, transfer, assign or sub-license your access to the Wi-Fi Service (or any part of it) or pass on your log-in details to anyone else.
The Wi-Fi Service is made available to you free of charge and is intended to enhance your visit to the NEC Venue at which it is offered. We are not required to offer the Wi-Fi Service at any particular NEC Venue, and may discontinue or suspend the Wi-Fi Service at any time and for any reason without liability to you. We do not guarantee, and shall have no liability in respect of:
a) the availability of the Wi-Fi Service;
b) the speed at which you may upload or download when connected to the Wi-Fi Service; or
c) that the Service will be compatible with your device.
Whilst we take reasonable steps to ensure the security of the Wi-Fi Service and to prevent unlawful access to information transmitted using it, you acknowledge that the transmission of information via the internet and via the Wi-Fi Service is not secure. Any transmission or use of the Wi-Fi Service is entirely at your own risk.
You may not use any registered trade marks, names, brands or logos belonging to the NEC Group, or imply any association between you and the NEC Group without our express written authorisation.
The Content You Access
NEC Group is proud of its reputation as being a family friendly and socially responsible company. For this reason, the Wi-Fi Service may be subject to content filters which seek to block access to certain types of content. However, we shall not be held responsible if you access any content that you or others consider harmful or inappropriate to minors, or otherwise offensive. By using the Wi-Fi Service, you confirm that you are either aged 18 or older or have the permission of your parent or guardian to use the Wi-Fi Service.
You may not use the Wi-Fi Service to send or receive any content which:
a) is defamatory, threatening, or which could be classed as harassment;
b) contains obscene, profane or abusive language;
c) is sexually explicit;
d) infringes the intellectual property rights of any third party; or
e) is otherwise unlawful or inappropriate.
You may not use the Wi-Fi Service:
a) in a manner which is excessive or may place an unusual burden on the Wi-Fi Service (e.g. by streaming video content or downloading large files); or
b) to attempt to gain unauthorised access to computers or networks owned by NEC Group or any third party.
Criminal Activity
You may not use the Wi-Fi Service to engage in any activity which constitutes or is capable of constituting a criminal offence in the United Kingdom.
You agree and acknowledge that:
a) we may cooperate with and provide information to law enforcement, governmental agencies and rights-holders in connection with your use of the Wi-Fi Service; and
b) we may keep a log of the Internet Protocol (“IP”) addresses of any devices which access the Wi-Fi Service, together with the dates and times of such access and the activity associated with that IP address.
Our Liability to You
Nothing in this Agreement shall restrict or exclude our liability for:
a) death or personal injury arising from our negligence;
b) our liability for fraud or fraudulent misrepresentation; or
c) any other liability which cannot be excluded or limited by law.
The Wi-Fi Service is provided for the convenience of visitors to NEC Venues. we do not guarantee that the service will be error free or uninterrupted. Therefore, you should not rely on the Wi-Fi Service for business matters, particularly those of an important or time critical nature, and we therefore disclaim our liability in contract, tort (including negligence), breach of statutory duty or otherwise arising in respect of:
a) loss of income or revenue;
b) loss of business;
c) loss of profits or contracts;
d) loss of opportunity or goodwill;
e) loss of, damage to, or corruption of data; or
f) indirect or consequential losses of any kind.
If you are an exhibitor or otherwise would like to use Wi-Fi services for business purposes, you may wish to take advantage of one of our prioritised Wi-Fi services. Please note that the prioritised Wi-Fi services provided by NEC Group will be governed by separate terms and conditions. Compensation
You agree to compensate the NEC Group, along with our subsidiaries, agents and employees, for all liabilities, claims, losses or damages (including legal fees) costs and other expenses, however caused, that may arise as a result of or in connection with your use of the Wi-Fi Service.

Notices
Any notice under this Agreement may be posted to you, served personally or sent via e-mail, to any address, e-mail address or phone number you have given us.
Notices to us may be sent via post as follows: Company Secretary, The National Exhibition Centre Limited, The NEC, Birmingham, B40 1NT.
Law and Jurisdiction
This Agreement is governed by English law and the courts of England and Wales will have exclusive jurisdiction. If you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.
